Haulx Privacy Policy for Users and Delivery drivers.

1.Introduction

This Privacy Policy is incorporated by reference into the Haulx Technologies (Pty) Ltd.  The term “Haulx,” “we,”, “our ” and “us” includes Haulx Technologies (Pty) Ltd. and our affiliates and subsidiaries. The term “you” or “your” refers to the customer, user, delivery driver or driver who requests, receives and/or provides a delivery service through their Haulx app or Haulx driver app account.

Please note, that our websites and apps may contain links to other third-party websites. If you follow a link to any of those third-party websites, know that they have their own privacy policies and that we do not accept any responsibility or liability for their policies or their processing of your personal data. Please check these policies before you submit any personal data to such third-party websites.

2. Personal data that we process

We only process information that we need, so we can provide you with the best service on our goods delivery marketplace.

2.1. Haulx App

  • Contact details such as name, phone number and email address.
  • Profile information such as your profile picture, saved addresses, language and communication preferences. 
  • Geolocation such as delivery pick-up, or the location of a nearby delivery driver to you, the time, progress of the delivery and the drop-off destination of your goods or item’s.
  • Payment information like the amount charged and the payment method used. We process online payment through our third-party provider (read their privacy policy when you are redirected to their site through our links on the website or app) whereas cash payments are made directly to the delivery driver.
  • Communication and correspondence records such as when you engage with our in-app chat, or speak with our customer service agents.
  • Limited identification data of the device, like the IP address, on which the Haulx app has been installed
  • Data about the usage of the delivery services such as  data about delivery times, status and data about your conduct as rated by delivery drivers.
  • Data related to communication through In-app instant messages in the Haulx app (“Chat” option) such as date and time of the communication and its content.
  • User generated content such as pictures, videos or files uploaded as part of delivery of a service (users are required to take images/pictures of their delivery items when requesting a delivery for security and safety reasons). 

2.2. Haulx Driver App

  • Contact details such as name, e-mail, phone number, place of residence.
  • Geolocation data that is gathered through the Haulx system when the delivery driver uses a Haulx driver app such as geolocation of drivers and driving routes.
  • Information about vehicles that is provided by the delivery driver including registration number and compliance status.
  • Usage data such as delivery driver ratings, interaction and engagement on the Haulx system.
  • Identification data such as delivery driver’s licence, photo, and identity documents.
  • Offences data such as data about criminal convictions and offences, where permitted under local laws and regulations.
  • Data related to communication through In-app instant messages in the Haulx Driver app (“Chat” option) such as date and time of the communication and its content or correspondence records when you speak with our customer service agents.
  • Information required under applicable law for taxation purposes such as your taxpayer identification number, VAT ID, and banking account identifier.
  • User generated content such as pictures, videos or files uploaded as part of delivery of a service (delivery drivers are required to take images/pictures of the delivery items to validate the images that were uploaded by the user for safety purposes).
  • Data collected or received from Service providers who conduct vehicle and driver compliance checks, and criminal background checks, Users and third parties who provide information and content in connection to the delivery service or with regard to possible claims and disputes and/or Users who participate in our referral campaigns. 

3. Purpose for processing your data

3.1. Haulx App

We process your personal data so we can provide you with efficient delivery services of your goods or items:

  • We connect you with a delivery driver to help you find a bakkie, van or truck: We collect and process personal data for the purpose of connecting customers with delivery drivers to enable delivery of your large or sizeable items. In-app Instant messages in the Haulx app are processed to provide service and customer support, for security purposes and to improve our products and services, and for analysis.
  • We get your delivery items where you want them to go: We display geolocation data and the phone number of customers or users to delivery drivers during delivery transactions to enable pick-up and drop-off. This data is collected only when the Haulx app is activated. The collection of geolocation data stops after closing the Haulx app.
  • We make sure the app is optimal: We use contact details to notify customers and users of updates to the Haulx app so you can keep using our services. We also gather limited data from the device that you use to connect you with our internet, mobile and telephone services, and to help keep your account safe through authentication and verification checks.
  • We collect your payment: We obtain payment details to process customer payment on behalf of delivery drivers for delivery of goods or items.
  • We maintain and promote standards: We collect data about delivery statuses, time and user ratings from delivery driver feedback to encourage user safety, promote compliance with our terms and conditions. Customer support data and correspondence is collected for the purposes of feedback, and resolving disputes and service quality issues. 
  • We keep you informed: Your name, phone number and email address will be used to communicate with you for things like letting you know that your delivery has been completed, sending you delivery confirmation receipts.

3.2. Haulx Driver App

We process delivery driver’s personal data for various purposes as follows:

  • For service provision, We collect and process personal data for the purpose of connecting customers with delivery drivers to enable delivery of large or sizeable items.
  • For service provision, geolocation is processed to analyse the geographical area and give suggestions to the delivery drivers of the areas that are busy through the heat map feature in the Haulx drive app. If you do not want to disclose your geolocation for customers, close the Haulx driver app or go offline in the Haulx driver app.
  • Driver’s licence, professional driver permit, identity documents and criminal convictions and offences are processed to determine the compliance with the legal requirements.
  • For service provision, the Haulx driver app displays driver’s photo, name and vehicle details for the customer to identify the delivery driver and vehicle.
  • Personal data related to In-app Instant messages in the Haulx driver app are processed to provide service and customer support, for security purposes and to improve our products and services, and for analysis.
  • We collect data about delivery statuses, time and driver ratings from customers feedback to encourage user safety, promote compliance with our terms and conditions. Customer support data and correspondence is collected for the purposes of feedback, and resolving disputes and service quality issues.
  • We may process all personal data about you for the establishment, exercise or defence of legal claims.

4. Legal Disclosures of your data

  • Personal data is generally processed to provide the services contracted through the Haulx app  or the Haulx driver app with you to meet our terms and conditions & obligations. In other circumstances, We process your personal data for legitimate reasons such as investigating and detecting fraudulent, malicious activities or responding to criminal acts.
  • We may process your personal data: 
    • to comply with a legal obligation if there is a valid legal request to disclose personal information to a third party such as a Court or regulatory authority;
    • to protect your vital interests, or those of others.

5. Recipients of your personal data

We share your data only with trusted partners and authorities for the provision of service as such we don’t sell your personal information.

5.1 Haulx app

  • The personal data of the customer is only disclosed to the delivery drivers when they engage for a delivery in the Haulx app (the driver will see the name, profile photo, phone number and geolocation data of the customer).
  • Feedback by customers regarding the delivery service is anonymous and is between you and Haulx.
  • Under a Court Order, we may be obliged to share information with external recipients.

5.2 Haulx Driver app

The personal data of the delivery driver is only disclosed to the customer when you have;

  • Received an order (your name and profile photo).
  • Accepted an order (driver’s name, vehicle, phone number, photo and geolocation data. Customers also see driver’s personal data in their receipt).
  • Under a Court Order, we may be obliged to share information with external recipients.

6. Security and access of your data

Any personal data collected in the course of providing services is transferred to and stored in the data centres of Amazon Web Services, Inc. Only authorised employees of Haulx Technologies (Pty) Ltd.  and partners have access to the personal data and they may access the data only for the purpose of resolving issues associated with the use of the services including disputes regarding delivery services.

7. Processing customer personal data

7.1 Haulx Driver

You may not process the personal data of customers without the permission of us. You may not contact any customers or collect, record, store, grant access, use or cross-use the personal data provided by the customer or accessible to you through the Haulx driver app for any reason other than for the purposes of fulfilling the delivery services.

8. Rights and controls of your data

Haulx provides you with controls through our apps where you can view your personal information such as delivery history, wallet balance or profile information. We also offer transparent cookie consent controls on our website.

  • You can access your personal data through the Haulx app or Haulx driver app. 
  • You can access and update your personal data through the Haulx app or Haulx driver app. You have the right to ask us to rectify information you think is otherwise inaccurate. 
  • You have the right to ask us to erase your personal information.

9. Retention

  • Your personal data will be stored as long as you have an active Haulx account. 
  • If your account is closed, personal data will be deleted, unless such data is still required to meet any legal obligation, or for accounting, dispute resolution or fraud prevention purposes. Please note that Uninstalling the apps doesn’t cause the deletion of your personal data.
  • Financial data regarding delivery services will be retained according to accounting standards and statutory requirements.

10. Dispute resolution

Disputes relating to the processing of personal data are resolved through customer support (su*****@Ha***.ai.).
